1. 'Subscribers' (paid or unpaid) are defined as users of HCBD website services. If you use HCBD website services, you accept these conditions. Please read them carefully. In addition, when you use any current or future service or business (e.g., Profiles, Mailing Lists, Broadcast Email) you also will be subject to the guidelines, terms and agreements ("Terms") applicable to such service or business. If these conditions are inconsistent with such Terms, the Terms will control.

2. News announcements and other information may be submitted to HCBD by its Subscribers, who are responsible for the content and accuracy of all news announcements and other information submitted by it. HCBD is not responsible for verifying any facts contained therein. Subscriber represents and warrants to HCBD that (i) it has the right to deliver to HCBD all information and announcements being submitted, (ii) it will comply with all applicable laws, rules and regulations, including but not limited to the Children's Online Privacy Protection Act of 1998 and laws relating to "spam", and (iii) no information or announcements submitted by Subscriber will contain any content that is obscene, libelous, slanderous or otherwise defamatory, false or misleading or which violates any copyright, right of privacy or publicity or other right of any person. Subscriber grants a perpetual, royalty free right to use (including a right to publish, copy, distribute and make minor edits). Subscriber shall indemnify and hold harmless HCBD, its affiliated companies and its third party business partners/associations including distributors, from and against any and all claims, losses, damages, liabilities, costs and expenses (including attorney's fees) arising out of or relating to any breach by Subscriber of the foregoing representations and warranties or otherwise arising out of or relating to the contents or nature of announcements and other information provided by Subscriber.

3. HCBD reserves the right to reject or edit announcements or other information when necessary in its judgment.

4. HCBD endeavors to disseminate promptly and accurately all news and other information that it processes. Any inadvertent errors by HCBD will be corrected promptly upon discovery, without charge, and such obligation to correct shall constitute the sole liability of HCBD in this regard.

5. HCBD is not warranting or ensuring that HCBD’s services will be free from errors, including omissions, interruptions, delays, losses or defects, whether human or mechanical. HCBD makes no warranties, expressed or implied, as to its services, including but not limited to any warranties of merchantability or suitability for print or broadcast. The liability of HCBD and its affiliates to Subscriber shall be limited to the refund of fees paid by Subscriber and in no event will HCBD or its affiliates be liable for any indirect, consequential, special, exemplary or incidental damages.

6. All news releases and other information transmitted by HCBD must contain a Subscriber-supplied contact name and phone number and a clearly identifiable source.

7. By its submission of announcements and/or other information to HCBD, Subscriber agrees to be bound by the foregoing Conditions of Service.
